This website and the services described on it are provided by Kristian Ian C. Quijano, operator of IMACCSTUDIO ("we", "us"), based in Cebu, Philippines. IMACCSTUDIO is an owner-operated studio rather than a registered company.

These terms apply to your use of this website and, where relevant, to the services we provide. They are written in plain English rather than heavy legal language.

Where a specific project is agreed, the quote, proposal, invoice or written agreement for that project sets out the commercial detail. If anything there conflicts with this page, the project-specific agreement applies.

1. Acceptance of terms

By using this website or engaging our services, you accept these terms. If you do not agree with them, please do not use the website or the services.

2. Website use

You may use this website for lawful purposes — to learn about our services and to get in touch. You agree not to misuse it, including by attempting to gain unauthorised access, interfering with its normal operation, scraping it at a scale that disrupts service, or using it to send unlawful or harmful content.

Website content is provided for general information. We aim to keep it accurate and current, but we do not promise it is complete or error-free at all times.

3. Our services

IMACCSTUDIO provides design and production services for marketing campaigns. These may include:

  • landing page design
  • landing page development and build
  • campaign creative production
  • test-ready landing page variations
  • thank-you page design and build
  • design revisions within an agreed scope
  • quality assurance and launch preparation

The exact services included in any engagement are those set out in the agreed quote, proposal, invoice or project agreement. Services offered may change over time.

4. Quotes and project scope

Each project's scope is defined in the accepted proposal, quote, invoice, agreement or written confirmation for that project. Pricing shown on this website is indicative and does not by itself form a binding quote.

Work that falls outside the agreed scope — including additional pages, additional variations, new creative directions, added functionality or work arising from a change of brief — may require additional fees or a new quote. We will discuss that with you before proceeding.

5. Client responsibilities

Projects run on time when the inputs arrive. You are responsible for providing, and for having the right to provide:

  • approved or authorised copy
  • accurate business, offer and campaign information
  • trademarks and logos you have permission to use
  • images and other assets you have permission to use
  • campaign requirements and any technical constraints
  • any account or platform access needed to complete the work
  • timely feedback and approvals

Delays in providing these may affect timelines. We rely on your confirmation that you hold the necessary rights and permissions for materials you supply.

6. Revisions

Revisions are provided within the scope agreed for the project. Revisions are intended to refine the work as briefed.

Material changes may fall outside that scope and may require additional time, fees or a new quote — for example changes to campaign strategy, approved copy, the offer, page architecture, creative direction, or added functionality.

7. Landing page variations

Where a package includes multiple test-ready landing page variations, those variations are campaign variations built around the same approved project, brand, copy and underlying creative direction.

They do not automatically mean multiple completely independent bespoke concepts, unless that is specifically agreed in writing.

Variations are intended to test meaningful differences such as:

  • hero treatment
  • call-to-action placement
  • form placement
  • proof and trust placement
  • page flow and section ordering
  • conversion emphasis

8. Meta ad variations

Advertising creative variations are produced for campaign testing — to give your team more to test, aligned with the landing page.

Where a package refers to ongoing ad variations, the applicable volume, campaign period, revision cycles and fair-use expectations are those set out in the relevant project agreement. Ongoing production is not unlimited unless that is specifically agreed in writing.

We do not guarantee that any particular creative will be a winning creative, or that it will achieve any particular result.

9. Performance disclaimer

Landing pages, creative variations, conversion recommendations, A/B testing recommendations and campaign assets are designed to support marketing performance. Results vary.

Performance depends on many factors outside our control, including:

  • the advertising platform and its policies or algorithm changes
  • traffic quality, audience and targeting
  • the offer and pricing
  • brand reputation and market perception
  • budget and campaign management
  • competition and market conditions

For that reason we do not guarantee conversion rates, leads, sales, return on ad spend, revenue or campaign performance.

10. AI-assisted production

We are open about how the work is produced. We may use modern AI-assisted design, development, research and production tools as part of our workflow, because they let us move faster.

AI is part of the production process, not the whole of it: work is reviewed and refined by us before it reaches you. AI-assisted output is not automatically correct, and it is not guaranteed to be free of errors — which is exactly why the review step exists. Deliverables remain subject to your own review and approval.

11. Third-party platforms

Delivering the services may rely on third-party providers and platforms — for example hosting platforms, advertising platforms, analytics providers, CRM systems, form providers, scheduling tools and domain providers.

Those services operate independently of us. We are not responsible for outages, policy changes, pricing changes, account suspensions, data loss or other failures caused by third-party services outside our reasonable control. Where something like that happens, we will make reasonable efforts to help you work around it.

12. Intellectual property

  • Your materials stay yours. You retain ownership of the copy, logos, images, brand assets and other materials you supply.
  • Our underlying tools stay ours. We retain ownership of our pre-existing tools, systems, methods, templates, components, processes and know-how, including anything developed independently of your project.
  • Final deliverables — ownership or licensing of the finished project deliverables is determined by the relevant project agreement and by payment status.

13. Portfolio and white-label work

We work with agencies, often behind the scenes. Public display of work produced for a client — including in a portfolio, case study, social post or advertisement — is subject to the relevant project agreement or to the client's permission.

Where a white-label arrangement is agreed, that arrangement is respected and the relationship is kept confidential on the agreed terms.

14. Payment

Payment terms are stated in the applicable quote, invoice, proposal or project agreement, including amounts, currency, schedule and any conditions for starting or releasing work.

15. Cancellation and suspension

Either party may end an engagement in line with the relevant project agreement. Where an engagement ends part-way, work completed up to that point remains payable in accordance with that agreement.

We may pause work where required information, approvals or access have not been provided, or where payment terms are not met, and will let you know if that happens.

16. Limitation of liability

To the extent permitted by law, our total liability arising out of or in connection with a project is limited to the fees paid for that project.

To the extent permitted by law, we are not liable for indirect or consequential loss, including lost profits, lost revenue, lost advertising spend, lost data or lost business opportunity.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including rights you may have under consumer protection law that apply regardless of contract.

17. Indemnity

You agree to be responsible for claims arising from materials you supply to us — for example a claim that copy, images, logos or other assets you provided infringe someone else's rights, or that a claim made in your approved copy is inaccurate. This does not apply to anything caused by us.

18. Governing law

These terms are governed by the laws of the Republic of the Philippines. The parties submit to the non-exclusive jurisdiction of the courts of Cebu City, Philippines.

Nothing in these terms excludes any mandatory rights or protections that apply under the laws of a customer's own jurisdiction — including consumer and small-business protections in Australia, the United Kingdom, the European Union, the United States or elsewhere — and nothing here prevents you from bringing proceedings in your own jurisdiction where that law gives you the right to do so.

19. Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top of this page shows when they were last revised. The terms that apply to an agreed project are those in place when that project was agreed, together with the project agreement itself.
